Terms of Service
Christian Parents Forum (CPF) is an online community for parents that allows
members to create unique personal profiles online and communicate with parents
around the world. The CPF is hosted by servers based in the State of Illinois,
is based at the following URL:
http://www.christianparentsforum.com and run by various individuals
collectively known as the CPF Administrators.
This Terms of Service (TOS) sets forth the legally binding terms for your use of
the CPF. By using the CPF you agree to be bound by this Agreement, whether you
are a "Visitor" (which means that you simply browse the CPF Website) or you are
a "Member" (which means that you have registered with CPF). The term "User"
refers to both a Visitor and a Member.
You acknowledge that CPF may review your Content for adherence to our guidelines
on the Forum Rules page and compliance with the TOS set forth in this agreement.
CPF and its designees shall have the right to remove any Content that violates
the TOS, Forum Rules, or is otherwise objectionable to CPF as determined by the
CPF Administrators.
You are only allowed to use the CPF if you agree to abide by all applicable laws
and to this Agreement. Please read this Agreement carefully. IF YOU DO NOT AGREE
WITH IT, YOU SHOULD LEAVE THE CPF WEBSITE AND DISCONTINUE USE OF THE CPF
SERVICES IMMEDIATELY. If you wish to become a Member, communicate with other
Members, and enjoy the services available to Members, you must read this
Agreement and indicate your acceptance during the Registration process.
CPF Administrators provide Users with an online community service via the CPF
message areas, pursuant to the terms set forth below (the "TOS"). CPF
Administrators may change the TOS at any time, with or without prior
notification. You may also be subject to additional terms and conditions that
may apply when you use or purchase affiliate or third-party services.
1. REGISTRATION DATA
You agree to provide CPF Administrators with complete and accurate registration
information as requested and to update this information as required to keep it
current. You agree to remain solely responsible for all such information
including your choice of username, should it be considered an infringement on
the copyright and/or trademark rights of any company, organization or
individual. Registration information will be the true and actual information
requested. Fraudulent registration information will result in immediate removal
of the User from the CPF.
2. SUBSCRIBER CONDUCT
By registering and posting on the CPF, you are agreeing that you will both read
and abide by the Forum Rules and the Terms of Service.
You are solely responsible for the content you upload or download through CPF.
You warrant that you will not:
• send unsolicited email directed to people not personally known to you,
including but not limited to junk mail, chain letters, or other unsolicited bulk
email, commercial or otherwise;
• transmit or post content on/from this site that is unlawful, harmful, abusive,
threatening, defamatory, invasive, vulgar, obscene, or that contains viruses or
other similar harmful programming;
• impersonate any person or entity, including, but not limited to, an CPF
Administrator, representative, or host, or falsely state or otherwise
misrepresent your affiliation with a person or entity;
• engage in attempts of fraud or forgery, including, but not limited to, forging
message headers or manipulating identifiers in order to alter or disguise the
origin of any transmitted content;
• interfere with or disrupt CPF or servers or networks connected to it;
• infringe on any third party's intellectual property rights or proprietary
rights, or rights of publicity or privacy.
• You will obey any requirements, procedures, policies or regulations of CPF
with regards to content, storage space, traffic, bandwidth, and other
conditions.
• You agree you will not submit forum posts or upload images that contain any
obscene, lewd, excessively violent, harassing, sexually explicit or otherwise
objectionable content.
• NO SPAM. Duplicate and spamming posts will be removed without notice, and
offending members may be summarily banned.
• Intentionally or unintentionally violate any applicable local, state, national
or international law and any regulations having the force of law while using
CPF.
• At the sole discretion of the management of CPF and the CPF Administrators, a
member's account can be removed or suspended should they be deemed in violation
of the TOS.
3. PRIVACY
Account information, registration data and certain other information about you
is subject to our Privacy Policy.
You acknowledge, consent and agree that CPF may access,
preserve and disclose your account information, including your ISP address, and
Content if required to do so by law or in a good faith belief that such access,
preservation or disclosure is reasonably necessary to: (a) comply with legal
process; (b) enforce the TOS; (c) respond to claims that any Content violates
the rights of third parties; (d) respond to your requests for customer service;
or (e) protect the rights, property or personal safety of CPF, its users and the
public.
4. RULES RELATING TO MINORS
CPF use is limited to those persons 13 years of age or older as attested to
during the registration process.
5. PERSONAL USE
Your right to use CPF is personal and is extended only to you. Please guard your
account password, as you are liable for all uses of your account, including any
unauthorized use.
6. INDEMNIFICATION
You will indemnify and hold harmless the CPF Administrators, their employees,
directors, officers, agents, and their successors and assigns from any damages
and expenses relating to the use of your account.
7. DISCLAIMER OF WARRANTIES
You use CPF at your sole risk. CPF is provided on an "as is" and "as available"
basis. CPF Administrators expressly disclaim all warranties of any kind, whether
express or implied, including, but not limited to, the implied warranties of
merchantability, fitness for a particular purpose, and non-infringement.
CPF Administrators do not make any warranty that CPF will meet your
requirements, or that the services will be uninterrupted, timely, secure, or
error-free; nor does CPF Administrators make any warranty that the results that
you may obtain through CPF meet your needs or that they will correct any
software defects. CPF Administrators does not make any warranty regarding any
goods or services purchased or obtained, or any transactions entered into
through CPF.
Any material and/or data you download or otherwise obtain through CPF comes at
your own discretion and risk. Any advice or information, whether oral or
written, which you obtain from CPF Administrators or through CPF will NOT create
any warranty not expressly stated in the TOS. Neither CPF nor anyone associated
with CPF represents or endorses the accuracy or reliability of any advice,
opinion, statement or other information displayed, uploaded or distributed
through the service by any user, information provider or any other person or
entity. You acknowledge that any reliance upon any such opinion, advice,
statement, memorandum or information shall be at your sole risk. The material in
this web site could include technical inaccuracies or other errors. Your use and
browsing of the web site is at your risk.
We at CPF reserve the right to reveal your identity (or
whatever information we know about you) in the event of a complaint or legal
action arising from any message posted by you.
8. LIMITATION OF LIABILITY
IN NO EVENT SHALL CPF ADMINISTRATORS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY
INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES,
INCLUDING LOST PROFIT DAMAGES ARISING FROM YOUR USE OF THE SERVICES, EVEN IF CPF
HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO
THE CONTRARY CONTAINED HEREIN, CPF FORUM'S LIABILITY TO YOU FOR ANY CAUSE
WHATSOEVER AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE
LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO CPF FOR THE SERVICES DURING THE
TERM OF MEMBERSHIP.
9. PROPRIETARY RIGHTS
By uploading images or other content onto this forum, you warrant that you are
the legal owner of the copyright to the images and have full legal rights to
publish this material.
CPF has the right (but not the obligation) to review any Content and delete any
Content that in the sole judgment of CPF violates the TOS, is prohibited
content, is illegal, violates the rights, harms, or threatens the safety of any
User or any other person, or creates liability for CPF, its suppliers, service
providers, partner companies, or any User. CPF reserves the right (but has no
obligation) to investigate and take action in its sole discretion against you if
you violate this provision or any other provision of the TOS, including without
limitation, removing Prohibited Content from the Services, terminating your
membership, reporting you to law enforcement authorities, and taking legal
action against you.
Content, including but not limited to text, software, music, sound, photographs,
graphics, video, or other material presented to you by CPF Administrators may be
protected by copyrights, trademarks, or other intellectual property rights and
laws. You may use this material only as expressly authorized by the original
owner.
Copyright Policy: It is the policy of the CPF policy to terminate membership
privileges of any Member who repeatedly infringes copyright upon prompt
notification to CPF by the copyright owner or the copyright owner’s legal agent.
Without limiting the foregoing, if you believe that your work has been copied
and posted on the CPF or used in any way that constitutes copyright
infringement, please provide the CPF administrators with the following
information: (i) an electronic or physical signature of the person authorized to
act on behalf of the owner of the copyright interest; (ii) a description of the
copyrighted work that you claim has been infringed; (iii) a description of the
location on the CPF of the material that you claim is infringing; (iv) your
address, telephone number, and email address; (v) a written statement by you
that you have a good faith belief that the disputed use is not authorized by the
copyright owner, its agent, or the law; (vi) a statement by you, made under
penalty of perjury, that the above information in your notice is accurate and
that you are the copyright owner or authorized to act on the copyright owner’s
behalf.
CPF Administrators do not claim any ownership rights in the text, files, images,
photos, video, sounds, musical works, works of authorship, or any other
materials (collectively, "Content") that you post to the CPF. After posting your
Content to the CPF, you retain all ownership rights in such Content, and you
continue to have the right to use your Content in any way you choose. By
displaying or publishing ("posting") any Content on or through the CPF, you
hereby grant to CPF Administrators a limited license to use, modify, publicly
display, reproduce, and distribute such Content solely on and through the CPF
and related promotional activity.
10. TERMINATION
Failure to comply with the TOS may result in the termination of your account,
with or without notice. This is at the sole discretion of the CPF
Administrators.
11. MODIFICATIONS
CPF Administrators may at any time augment or enhance the current service with
new or different features, with or without prior notification.
12. MISCELLANEOUS
The TOS is governed by the laws of the United States of America, the state of
Maryland. If any provision of the TOS is held to be invalid or unenforceable,
such provision shall be struck and the remaining provisions shall be enforced.
CPF Administrator’s failure to act with respect to a breach of the TOS by you or
others does not waive CPF Administrators right to act with respect to subsequent
or similar breaches. The TOS sets forth the entire agreement between you and CPF
Administrators, and supercedes any prior agreements pertaining to the subject
matter contained herein.
13. VIOLATIONS
Please report any violations of the TOS to: webmaster (“at”)
